Please read these Terms of Service ("Terms", "ToS") carefully before using getMixManager.com (the "Website") and any related services, including our software product MixManager ("Software").

By accessing or using our Website, downloading our Software, or creating an account, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Website or use our services.

1. Definitions

• "Account" means a registered user account on our Website
• "Content" means any information, data, text, software, graphics, or other materials
• "License Key" means the unique activation code that unlocks the full functionality of the Software
• "Software" means MixManager and all related components
• “Basic Mode" means the limited functionality version of the Software available without a License Key
• "User," "you," or "your" means any individual or entity using our Website or Software

2. Account Registration and Security

2.1 Account Creation

You must create an account to purchase License Keys and manage your licenses. Account creation requires providing accurate, current, and complete information. You must be at least 18 years old or have legal guardian consent to create an account. We reserve the right to refuse account creation at our discretion. Multiple accounts are prohibited unless explicitly authorized by us.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must use strong passwords and update them regularly. You must notify us immediately of any unauthorized access or security breaches. You are responsible for all activities that occur under your account. We may suspend or terminate accounts that violate these Terms or show signs of unauthorized use.

2.3 Account Information

You must keep your account information up to date. You must provide a valid email address for account-related communications. We may verify your information through third-party services. False or misleading account information may result in termination.

3. Software Download and Usage

3.1 Software Access

The Software download package includes both basic and full functionality. The initial download does not require an account. The Software is protected by copyright and other intellectual property laws. Your use of the Software is also governed by our End User License Agreement (EULA)

3.2 Basic Mode

Basic Mode is automatically activated upon initial Software installation. It includes limited functionality as specified on the Website. Basic Mode limitations may include: limit of people and their settings. We reserve the right to modify Basic Mode features and limitations. Basic Mode is provided "as is" without warranty or guarantee.

3.3 Download Terms

Downloads must be initiated through our official Website. You may download and install the Software on devices you own or control

• You may not:
  • Distribute or share the Software download
  • Modify or create derivative works of the Software
  • Attempt to reverse engineer the Software
  • Use automated systems to download the Software
  • Bypass any download restrictions or security measures
• We may impose download limits or restrictions to prevent abuse
• We may track download activities for security purposes

4. Licenses and Activation

4.1 License Keys

License Keys are required to unlock full Software functionality. Valid account and payment are required for License Key purchase. Each License Key is unique and tied to your account

• License Keys may not be:
  • Shared or redistributed
  • Sold or transferred without our permission
  • Used on more devices than permitted
• We maintain records of License Key usage and activation

4.2 License Management

License management requires an active account. You may view your licenses through our Website dashboard. All licenses must be deactivated and activated using the Software. A special request can be made to [email protected] to deactivate a license when the device containing the Software has been lost, stolen, wiped, or damaged to where on device deactivation is impossible. BZ Innovations, LLC reserves the right to grant or decline this special request with no explanation.

We may limit the number of license transfers or deactivations.

4.3 License Enforcement

The Software may verify license validity periodically. The Software will logout and revert to Basic mode after 30 days of use without connection to the Internet. Invalid or revoked licenses will result in Software reverting to Basic Mode. We reserve the right to revoke licenses for Terms violations. Attempting to circumvent license enforcement may result in permanent license revocation

5. Payments and Billing

5.1 Pricing

All prices are listed in USD. Prices are subject to change without notice. Price changes will not affect already purchased licenses. We may offer promotional pricing at our discretion.

5.2 Payment Terms

Payments must be made through our approved payment processor, Paddle. You must provide valid payment information. You authorize us to charge your payment method. Failed payments may result in service interruption.

5.3 Refunds

Refund requests must be submitted within 14 days of purchase.

• We may deny refunds for:
  • Terms violations
  • Excessive refund requests
  • License Key misuse

Approved refunds will be issued to the original payment method. Refund processing may take up to 2 business days.

6. Acceptable Use

6.1 Website Use

You agree not to:

• Use the Website for any unlawful purpose
• Attempt to gain unauthorized access
• Interfere with Website operation
• Upload malicious content
• Scrape or harvest data
• Impersonate others
• Generate automated traffic

6.2 Software Use

You agree not to:

• Modify or tamper with the Software
• Attempt to bypass licensing mechanisms
• Use the Software to violate laws
• Create competing products based on our Software
• Remove copyright notices or branding
• Use the Software in high-risk applications without written permission

7. Privacy and Data

7.1 Data Collection

We collect and process data as described in our Privacy Policy. The Software may collect diagnostic data when issues occur for debugging purposes. We use industry-standard security measures. We comply with applicable data protection laws.

7.2 Communications

We will send you essential service communications. You may opt out of marketing communications. We will not sell your email address or any other information.

8. Ownership

8.1 Feedback and Suggestions

By providing feedback or suggestions to us, you agree that we may use, implement, and modify any feedback or suggestions you provide without any obligation to compensate you or provide you with credit. You grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use and incorporate your feedback and suggestions into our products and services.

8.2 Restrictions

You may not:

• Copy or reproduce our Content
• Remove copyright notices
• Use our trademarks without permission
• Create derivative works
• Reverse engineer our Software

9. NO WARRANTY

9.1 Warranty Disclaimer

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE WEBSITE AND SOFTWARE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SOFTWARE AND ANY SERVICES PERFORMED OR PROVIDED BY THE WEBSITE AND SOFTWARE ARE PROVIDED "AS IS" AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE WEBSITE AND SOFTWARE AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE WEBSITE OR SOFTWARE OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

IN NO EVENT WILL BZ INNOVATIONS, LLC BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE WEBSITE OR SOFTWARE OR ANY OTHER SERVICE AND/OR CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE WEBSITE OR SOFTWARE, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR ARE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CAUSES OF ACTION AND UNDER ALL THEORIES OF LIABILITY WILL BE LIMITED TO THE AMOUNT YOU PAID TO BZ INNOVATIONS, LLC. THIS SECTION WILL BE GIVEN FULL EFFECT EVEN IF ANY REMEDY SPECIFIED IN THIS AGREEMENT IS DEEMED TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

9.2 Disclaimers and Limitations of Liability

The Website and Software is provided "as is" without warranties of any kind, either expressed or implied. Your use of the Website and Software is at your sole risk. BZ Innovations, LLC will not be liable for any damages arising from your use. Ensure you comply with all applicable laws and regulations while using the Website and Software. Third-party services are not guaranteed. Technical support is subject to availability.

9.3 Indemnification

You agree to indemnify and hold harmless BZ Innovations, LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Website and Software, your violation of these terms, or your violation of any rights of another.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be instituted in the state or federal courts located in Loudoun County, Virginia. You further agree that you and BZ Innovations, LLC will not commence against the other a class action, class arbitration or other representative action or proceeding.

11. Changes to Terms

BZ Innovations, LLC reserves the right to modify these terms at any time. We will notify you of any changes by posting the new terms on this page. Your continued use of the Website or Software after any changes indicates your acceptance of the new terms.
